eTourist Affiliate Program Terms & Conditions

These Affiliate Program Terms & Conditions ("Affiliate Terms") are an agreement between you ("Affiliate," "you," "your") and Travel Zoom LLC ("Travel Zoom," "we," "us," or "our"), the operator of eTourist.com (the "Service"). They govern your participation in the eTourist Affiliate Program (the "Program").

You accept these Affiliate Terms by ticking the acceptance box on the affiliate application form. By doing so, you also confirm that you have read our Terms and Conditions and Privacy Policy, both of which apply to you. If you are joining on behalf of a company, you confirm that you are authorized to bind that company, and "you" means that company.

The Program at a Glance

This summary is for convenience only — the full sections below are what bind us both.

  • Commission: 10–20% of the Net Service Fee on completed applications, based on your cumulative referral volume (the tier you have reached climbs as you refer more and never decreases). Commission is never paid on government fees.
  • Attribution: First click wins, tracked by a 60-day cookie.
  • Cost: Free to join. No setup fees, no monthly fees, no minimum traffic requirement.
  • Payouts: Monthly, once your approved balance reaches USD 100.
  • Holding period: Commissions are approved 30 days after the referred order is completed, to allow for refunds and disputes.

1. Joining the Program

  • Joining the Program is free. There are no setup fees, no monthly fees, and no minimum traffic requirements.
  • You must apply through our affiliate application form and provide accurate, complete, and current information, and keep it up to date.
  • Acceptance into the Program is at our sole discretion. We may decline any application, and we are not required to give a reason.
  • You must be at least 18 years old and able to enter into a binding contract.
  • You may hold one affiliate account. Duplicate accounts may be closed and their balances consolidated or, in the case of deliberate circumvention (for example, to manipulate volume tiers), forfeited.

2. The Affiliate Platform

The Program is operated on a third-party affiliate tracking platform (the "Platform"). Through the Platform we provide you with:

  • A dashboard showing your clicks, conversions, and earnings;
  • Your unique referral links; and
  • A library of creatives — banners, widgets, deep links, and text links.

Tracking, attribution, and reporting are performed by the Platform. By joining the Program you acknowledge that:

  • The Platform processes tracking and attribution data (such as click data, cookie identifiers, and conversion events) on our behalf, and processes your account and payout details as described in our Privacy Policy;
  • The Platform's records are the authoritative record of clicks, referrals, conversions, and commissions under the Program. In the event of any discrepancy between the Platform's records and your own analytics or records, the Platform's records control;
  • We may replace, upgrade, or reconfigure the Platform at any time. If a change materially affects tracking of your referrals, we will use reasonable efforts to notify you in advance.

The dashboard is provided as-is. Brief interruptions, delays in data display, or maintenance windows do not affect commissions you have properly earned and are not a breach of these Affiliate Terms.

3. Commissions

3.1 What Commission Is Paid On

Commission is calculated as a percentage of the Net Service Fee of each Qualified Referral.

  • "Service Fee" means the fees Travel Zoom charges for its own services — including our processing fee, expedited processing tiers, denial protection, and other optional add-on services purchased at checkout. It excludes government fees, which are charged by (or passed through to) the relevant government authority.
  • "Net Service Fee" means the Service Fee actually paid by the customer, after deducting any discounts, promotional credits, or coupons applied to the order, and excluding government fees, taxes (such as VAT or sales tax), and payment processing surcharges.
  • "Qualified Referral" means a completed, fully paid application on the Service that (a) is attributed to you under Section 4, (b) is placed by a genuine customer (not you, and not anyone acting on your instructions to generate commission), and (c) is not subsequently cancelled, refunded, charged back, or determined to be fraudulent.

To be explicit, because it matters in this industry: eTourist charges a service fee on top of the government's own visa or travel document fee. Your commission is calculated on our service fee only — never on the government fee.

3.2 Commission Tiers

Your commission rate increases as your cumulative number of Qualified Referrals grows over the life of your account:

Progression is based on your total Qualified Referrals to date, not a monthly figure. When your cumulative referrals cross a threshold, you advance to the higher tier permanently: the higher rate applies to Qualified Referrals completed after you advance, and your rate never decreases, even in a slower month. Qualified Referrals completed before you advanced keep the rate that was in effect when they completed; advancing is not applied retroactively.

3.3 Commission Approval and Holding Period

Commissions are first recorded as pending. A pending commission becomes approved (payable) 30 days after the referred order is completed, provided the order has not been refunded, charged back, disputed, or flagged as fraudulent during that period.

3.4 Reversals and Clawbacks

A commission (whether pending, approved, or already paid) is reversed if the underlying order is:

  • Refunded, in whole or in part (partial refunds reverse the commission proportionally);
  • Subject to a chargeback or payment dispute;
  • Cancelled, or closed as non-responsive or expired under our Refund Policy;
  • Found to be fraudulent, placed with a stolen payment method, or placed in violation of our Terms and Conditions; or
  • Attributable to your breach of these Affiliate Terms (for example, a prohibited promotional method under Section 5).

If a reversed commission has already been paid to you, we may offset the amount against your future commissions or, if your account is closed or the balance is insufficient, invoice you for the amount, payable within 30 days.

4. Attribution and Tracking

  • First-click attribution. Where more than one affiliate refers the same customer, the commission is credited to the affiliate whose link the customer clicked first, as recorded by the Platform.
  • 60-day cookie. When a visitor clicks your referral link, a tracking cookie valid for 60 days is set. If that visitor completes a qualifying purchase within that window, the referral is attributed to you.
  • No cookie, no commission. Tracking depends on the cookie (or equivalent tracking identifier) being present at the time of purchase. If the visitor has cleared or blocked cookies, uses a different browser or device than the one they clicked on, or purchases through a channel we cannot track, the referral cannot be attributed and no commission is payable. We will not manually attribute untracked sales, and the Platform's records are final (Section 2).
  • Use your links. Only traffic sent through your unique referral links (or other tracking methods we expressly provide) is eligible for commission.
  • No self-referrals. You may not earn commission on your own purchases, purchases made on your behalf, or purchases by your household members, employees, or business — whether made through your own link or otherwise. Self-referred commissions will be reversed and repeated self-referral is grounds for termination under Section 8.

5. Prohibited Conduct

The rules in this section exist to protect travelers and the eTourist brand. Breach of this section is grounds for immediate termination and forfeiture of commissions under Section 8.

5.1 No Government Impersonation — Zero Tolerance

eTourist is a private, commercial visa-assistance service. It is not a government agency and is not affiliated with, endorsed by, or acting on behalf of any government. This is the single most important rule of the Program. You must not:

  • State or imply that eTourist, Travel Zoom, or your own website is a government body, embassy, consulate, or official application channel;
  • Use government seals, crests, flags styled as official insignia, or ".gov"-styled design, wording, or domain elements in connection with your promotion of the Service;
  • Describe the Service as the "official" application, portal, or website for any visa or travel document;
  • Omit or obscure the fact that eTourist charges a service fee in addition to the government fee, where you present pricing;
  • Suggest that applying through eTourist is mandatory, or that travelers cannot apply directly with the government.

We enforce this rule without warnings. A single violation may result in immediate termination and forfeiture of all unpaid commissions.

5.2 No Misleading Claims

You must not make claims about the Service that are false, unsubstantiated, or that go beyond what our own website states at the time. In particular, you must not:

  • Guarantee, or imply a guarantee of, visa approval. Approval decisions are made solely by government authorities;
  • Guarantee processing or delivery times, or misstate our advertised processing times (which cover our internal processing only, not government decision times);
  • Misstate prices, fees, refund rights, or eligibility requirements;
  • Invent or alter statistics (for example, approval rates) — you may only quote figures currently published on eTourist.com, and must update or remove them if we change them;
  • Provide, or hold yourself out as providing, immigration or legal advice on our behalf.

5.3 No Brand Bidding or Brand Abuse

You must not:

  • Bid on, or purchase, paid search or paid social placements targeting the keywords "eTourist," "Travel Zoom," "etourist.com," or any misspelling, variation, or combination of them (including combinations such as "eTourist visa" or "eTourist review"), in any language;
  • Use our trademarks in ad copy, display URLs, ad extensions, or landing-page domains without our prior written consent;
  • Register, use, or traffic in domain names, subdomains, social media handles, or app names that are confusingly similar to eTourist or Travel Zoom (typosquatting and lookalike domains);
  • Represent yourself as eTourist, or design your site, emails, or ads to be mistaken for eTourist itself rather than an independent promoter of it.

5.4 No Tracking or Traffic Abuse

You must not:

  • Engage in cookie stuffing or any technique that sets tracking cookies without a genuine, user-initiated click (including hidden iframes, forced clicks, pop-unders, auto-redirects, or pixel drops);
  • Use adware, toolbars, browser extensions, or other software that injects your referral links, overwrites other affiliates' tracking, or intercepts traffic already heading to eTourist.com;
  • Scrape, publish, or advertise coupon or discount codes that we have not issued to you, or advertise nonexistent discounts to harvest clicks;
  • Generate clicks or conversions through bots, click farms, incentivized "cashback-for-signup" schemes we have not approved in writing, or any other artificial means;
  • Interfere with, reverse engineer, or manipulate the Platform's tracking.

5.5 No Spam

All email, SMS, and messaging promotion must comply with applicable anti-spam law (including CAN-SPAM, and where applicable GDPR/PECR and CASL). You must only message people who have validly opted in to hear from you, must identify yourself (not eTourist) as the sender, and must honor unsubscribes. Unsolicited bulk email, SMS, or direct messages promoting your referral links are prohibited.

5.6 Content Standards

You must not promote the Service on or alongside content that is illegal, sexually explicit, hateful, discriminatory, violent, defamatory, or that promotes illegal immigration, document fraud, or misrepresentation to government authorities, or that otherwise misrepresents immigration or visa law.

6. Compliance and Disclosures

  • Disclose the relationship. You must clearly and conspicuously disclose your affiliate relationship with eTourist wherever you promote the Service, in accordance with the FTC's Endorsement Guides (16 C.F.R. Part 255) and any equivalent rules in the jurisdictions where your audience is located (for example, ASA/CMA guidance in the UK). A clear statement such as "I may earn a commission if you purchase through my link" near the link satisfies this.
  • Data protection. If you collect any personal data in the course of your promotion (for example, email subscribers), you are the controller of that data and must comply with all applicable data-protection laws, including the GDPR, UK GDPR, and CCPA where they apply. You must not transfer personal data of your audience to us except through mechanisms we expressly provide.
  • General legality. You must comply with all laws applicable to your promotional activity, including advertising, consumer-protection, and e-commerce rules.
  • You are responsible for the content of your own websites, channels, and communications. We do not review or approve them, and hosting our creatives does not make us responsible for them.

7. Payouts

  • Schedule. Approved commissions are paid monthly, in the month following approval.
  • Methods. Payouts are made to the payout details you maintain in your affiliate account. You are responsible for keeping these details accurate; we are not liable for payments sent to details you provided.
  • Currency. Payouts are made in US Dollars (USD). If your account is in another currency, conversion is performed by your provider at its rates, and any conversion or receiving fees are yours.
  • Minimum payout threshold. A payout is made only once your approved balance reaches USD 100. If your balance is below the threshold at the end of a payout cycle, it rolls over — it is not forfeited — and is paid in the first cycle in which your approved balance meets the threshold.
  • Tax documentation. Before your first payout (and thereafter if requested), you must provide accurate tax documentation — a W-9 (US persons), W-8BEN / W-8BEN-E (non-US persons), or the local equivalent we reasonably request. We may withhold payouts until valid documentation is received, and may withhold amounts from payouts where required by law.
  • Dormant accounts. If your account has had no clicks, referrals, or logins for 12 consecutive months, we may mark it dormant and close it. On closure of a dormant account we will pay out any approved balance regardless of the threshold, less any transfer costs, using your last-provided payout details. If we cannot pay you because your payout details are invalid and you do not respond to our notices within 90 days, the balance may be forfeited to the extent permitted by law.
  • Errors. If we pay you in error (wrong amount, reversed commission, wrong account), you must return the overpayment or we may offset it against future payouts.

8. Term and Termination

  • Term. These Affiliate Terms take effect when we approve your application and continue until terminated.
  • Termination for convenience. Either party may terminate at any time, for any reason or no reason, by written notice (email suffices). Termination is effective on delivery of the notice.
  • Termination for cause. We may terminate immediately, without prior notice, if you breach these Affiliate Terms — including any violation of Section 5 — or if we reasonably suspect fraud.
  • Effect on commissions. What happens to your balance depends on why the relationship ended:
    • Termination for convenience (by either party): commissions already approved are paid in the next regular payout cycle even if below the minimum threshold. Commissions still pending at termination complete their normal 30-day holding period and, if they clear, are paid in the following cycle. No commission accrues on clicks or referrals after the termination date.
    • Termination for fraud or material breach: all unpaid commissions — pending and approved — are forfeited. This is the only situation in which earned commissions are forfeited.
  • On termination you must promptly stop using your referral links, our trademarks, and our creatives, and remove them from your properties.
  • Sections 3.4 (Reversals), 6 (Compliance), 9 (Taxes), 12 (No Guarantees), 13 (Liability and Indemnity), and 15 (Governing Law) survive termination.

9. Taxes

You are an independent business. You are solely responsible for determining, reporting, and paying all taxes, duties, and social contributions on your commissions in your jurisdiction. Commissions are stated exclusive of any VAT or similar tax; if you are required to charge VAT on your services to us, you must tell us and invoice compliantly. We do not withhold taxes except where the law requires us to.

10. Relationship of the Parties

You are an independent contractor. Nothing in these Affiliate Terms creates an employment, agency, partnership, joint venture, or franchise relationship. You have no authority to bind Travel Zoom, make promises on our behalf, accept payments for us, or modify our terms with customers — and you must not suggest otherwise. Customers you refer are customers of Travel Zoom, and their orders are governed by our Terms and Conditions and Refund Policy, not by anything you tell them.

11. License to Use Our Materials

While you are in the Program, we grant you a limited, revocable, non-exclusive, non-transferable license to use the referral links, banners, widgets, and other creatives we make available through the Platform, and the eTourist name and logo as they appear in those creatives, solely to promote the Service in accordance with these Affiliate Terms. You may not modify our creatives (other than resizing without distortion), use our marks in ways Section 5.3 prohibits, or sublicense them. The license ends automatically when your participation ends. We retain all intellectual property rights in the Service, our marks, and our creatives.

12. No Guarantees

  • We do not guarantee that you will earn any particular amount, or anything at all. The earnings calculator and any figures on our marketing pages are illustrations, not promises.
  • We do not guarantee acceptance into the Program, continued availability of the Program, the availability of any commission tier, or the continued operation of any particular tracking platform, creative, or feature.
  • We may suspend the Program (for example, for fraud investigation or platform migration) with reasonable notice where practicable. Suspension does not affect commissions already approved.

13. Liability and Indemnity

  • The disclaimers, limitation of liability, and indemnification provisions of our Terms and Conditions apply to these Affiliate Terms and to your participation in the Program, and are incorporated by reference.
  • Without limiting the above: to the maximum extent permitted by law, our total aggregate liability to you arising out of or relating to the Program is limited to the total commissions paid or payable to you in the twelve (12) months preceding the event giving rise to the claim.
  • You agree to indemnify, defend, and hold harmless Travel Zoom and its affiliates, directors, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your promotional activities and the content of your properties; (b) your breach of these Affiliate Terms, including Section 5 and Section 6; or (c) your violation of any law or third-party right.

14. Changes to These Terms and Rates

We may modify these Affiliate Terms — including commission rates, tiers, the payout threshold, the holding period, and attribution rules — at any time by posting the updated terms and notifying you by email or through the Platform dashboard.

  • Changes are prospective only. A change never reduces commissions on referrals already completed before the change takes effect, and never applies retroactively to commissions already pending or approved.
  • Material changes (including any reduction in commission rates) take effect no earlier than 14 days after notice.
  • If you do not accept a change, your remedy is to terminate under Section 8; continuing to participate after the effective date constitutes acceptance.

15. General

  • Relationship to the general Terms. These Affiliate Terms supplement our Terms and Conditions. If they conflict on a matter concerning the Program, these Affiliate Terms control; on all other matters, the general Terms control.
  • Governing law and disputes. These Affiliate Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Disputes shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Any claim must be brought within one (1) year after it arose, and only on an individual basis — consistent with our general Terms.
  • Assignment. You may not assign these Affiliate Terms without our prior written consent. We may assign them (for example, in a corporate reorganization or sale) without notice.
  • Severability; waiver. If any provision is unenforceable, it is limited to the minimum extent necessary and the rest remains in force. A failure to enforce a provision is not a waiver of it.
  • Entire agreement. These Affiliate Terms, together with the documents they incorporate by reference, are the entire agreement between you and Travel Zoom concerning the Program.
